Discovery Fly Fishing, LLC. (“Discovery Fly Fishing,” “us”, “we” or “our”) provides products and services (“Services”) to individual recreational anglers (our “Customers”). The individuals who engage with our Customers and contribute to their recreational angling efforts through use of our Services are “End Users” of our Service.

We respect your rights and preferences regarding data privacy. In this Privacy Notice (“Notice”), we describe how we collect, use, and share personal information about our Customers, as well as End Users who interact with Discovery Fly Fishing website (“Site”) or other products and services (collectively, “Services”) for the purpose of participating in our Customers’ recreational angling efforts.

This Notice applies to the Services provided by Discovery Fly Fishing on its own behalf or in combination with one of its affiliates, or subsidiaries.

Please be aware that not all of the information in this Notice will be directly applicable to our handling of your personal information. If you are a Discovery Fly Fishing Customer, there may be additional terms that govern your use of the Services that are provided in the agreement you have with Discovery Fly Fishing. This Notice provides an overview of the possible circumstances in which we interact with your personal information. WHAT WE COLLECT ON THIS WEBSITE

This section describes, in plain terms, the specific information this website
collects. The more general categories below apply as well.

When you use the Trip-Ready Casting Assessment questionnaire, we ask for
your trip destination, the species you are fishing for, your trip date, what
you would most like to improve about your cast, your first name, your email
address, whether you booked through an agency or lodge (and which one, if you
tell us), and how you heard about us.

We use this to prepare for your sessions and to contact you about them. Your
destination and trip date are used to time the sessions against your departure.

When you use the Trip-Ready Casting Checklist, we record your score and
which of the five skill areas you did not check off. That tells us which things
anglers most often find difficult, and shapes what we write next. This happens
whether or not you give us your email address, and it is not tied to your name.

However you contact us, we also record how you arrived — the search,
advertisement, or link that first brought you to the site and the one that
brought you back most recently, and the identifier an ad platform attaches to
its own click. We keep this alongside your inquiry or subscription so we know
which of our advertising is worth paying for. It describes how you got here, not
who you are.

When you subscribe to our newsletter, we ask for your first name and email
address. The signup form appears on more than one page, and we record which page
you subscribed from. If you subscribe from the Trip-Ready Casting Checklist, we
also keep your score and the skills you did not check off against your
subscription, so what we send can speak to the things you told us you found
hardest. The newsletter carries casting notes, events and outings, news from the Drifter Den, and occasional offers, so subscribing means agreeing to receive promotional email as well as instructional email. You can unsubscribe at any time using the link in any email we send.

When you buy something, our store collects the information needed to take
and fulfill the order — your name, email address, billing details and what you
bought. Payment card details are handled by our payment processor and are never
stored by us.

Automatically, when you visit any page, we and the providers named in the
next section collect your IP address, your browser and device type, the page
you came from, which pages you view, how far down them you scroll, which
buttons you click, and how much of a video you watch. If you arrive from an
advertisement, we also receive the identifier the ad platform attaches to that
click.

What we do not put into our analytics. Names and email addresses are not
sent to our analytics or advertising providers. Where we need to connect a
questionnaire response to an order, we use a random identifier generated in
your browser that does not contain your name, your email address, or anything
else that identifies you.

PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT

Discovery Fly Fishing collects personal information about Customers or potential customers (“Customer Information”) for business purposes. When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your requests and purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

We will only collect, use, and share personal information where we are satisfied that we have an appropriate legal basis to do so. Subject to Customer consent if required by law, we may collect the following categories and types of Customer Information as relevant to the Services with which a Customer is engaging:

• Identifiers (including name and contact information including telephone number, email address, or postal address)
• Sensitive Personal Information (such as financial account information and username and password)
• Commercial Information (such as your access and purchase history, the Services we provide to you, your marketing preferences, or information you provide in any communication with us or when you participate in any blog, community or forum on our Sites)
• Internet/Electronic Activity (see “Cookies” for additional information)
• Geolocation Information
• Inferences drawn from the foregoing, such as Customer preferences, characteristics or predispositions

How we use your personal information. We use your personal information to provide the Services. In providing the Services, we may use your personal information for the following business purposes:

• Create, maintain or provide service for your account
• Process or fulfill requests from you
• Respond to customer service requests from you
• Send Customers whitepapers, updates, or notices about our organization, or emails about products or services that Customers have requested or we believe may be of interest
• Market to our Customers, subject to their consent if required by applicable law purposes.
• Verify Personal Information
• Conduct promotions our Customers have entered
• Process payments
• Undertake activities to maintain the quality, safety or integrity of the Services
• Maintain data security including detecting and responding to security incidents and protecting you, and us, from fraud and other malicious activity
• Monitor our Sites including gathering usage data and other analytic information that enables us to maintain and improve the Services
• To personalize your experience on our Sites
• Other uses that are required for us to meet our legal, contractual or regulatory requirements

Our Processing of Sensitive Personal Information: Sensitive Personal Information includes personal information defined as sensitive under the applicable privacy and data protection laws. When we collect Sensitive Personal Information about you, we will limit our use and disclosure of that information to what is necessary to perform the Services, unless we are required to do otherwise under applicable laws. In addition to processing Sensitive Personal Information as required to perform the Services, we may process Sensitive Personal Information to detect and prevent security incidents or fraud, to ensure the physical safety of natural persons, for short-term transient uses (when consistent with the purpose for which the information was collected), and to verify or maintain the quality or safety of any Services we perform. Under some privacy and data protection laws, you may have the right to limit the processing of your Sensitive Personal Information. You can find more information about your rights in other sections of this Notice, including any applicable section directed at residents of the state or country in which you reside.

SOURCES OF PERSONAL INFORMATION

We collect personal information from the following categories of sources:

Information that you provide to us: We collect personal information that you provide to us when you set up an account with us, use our Services, or communicate with us. For example, if you register for an online account with us, then we may request your name, contact information and payment information. Providing us with personal information about yourself is voluntary, and you can always choose not to provide certain information, but then you may not be able to take advantage of or participate in some of the Services’ features.

Information collected from third parties: We may collect Customer Information from third parties in the course of providing our Services to you. For example, we may collect personal information like Customer name and contact information from a trade show organizer where a Customer attended such event.

Information collected through technology: When you visit our Site, interact with an email we send to you, or use any of our Services, we may collect certain information automatically such as your account or device identifier, and usage information such as pages that you visit, information about links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services. You have the ability to express your preference regarding some of the ways we collect information through technology in some of our Services (see “Cookies and Other Tracking Technologies” for more information).

Data anonymization and aggregation.

Subject to your consent if required by law, we may anonymize or aggregate your personal information in such a way as to ensure that you are not identified or identifiable from it, in order to use the anonymized or aggregated data. For example, we may use anonymized or aggregated data for statistical analysis including to analyze trends, for product development, and for risk assessments and cost analysis. We may share anonymized or aggregated data with our parents, subsidiaries, affiliates or with other third parties.

This Notice does not restrict Discovery Fly Fishing’s use or sharing of any non-personal, summarized, derived, anonymized or aggregated information.

SERVICE PROVIDERS AND TRACKING TECHNOLOGIES WE USE

We use the following third parties. Each receives only what it needs, and each
processes information on our behalf under its own terms.

Cookies and similar technologies are used by the analytics and advertising
providers above, and by our store to remember what is in your cart. You can
delete or block cookies through your browser settings; if you do, the store may
not work correctly.

We do not currently use a cookie consent banner. Our advertising is directed to
the United States only, and we do not target advertising to visitors in the
European Economic Area or the United Kingdom.

HOW WE SHARE PERSONAL INFORMATION

Except as otherwise specified, we may share any of the categories of your personal information in the manner and for the purposes described below:

• With Discovery Fly Fishing affiliates where such disclosure is necessary to provide you with our Services or to manage our business.
• With third-party service providers. For example, we share personal information with IT service providers who help manage our back office systems or administer our Site. These third-party service providers have agreed to confidentiality restrictions and have agreed to use any personal information we share with them, or which they collect on our behalf, solely for the purpose of providing the contracted service to us.
• On Customer facing Sites only, we may share with advertising or social media networks for personalized marketing purposes (See “Cookies” for additional information”).
• We may share identifiers with logistics service providers to enable the delivery of packages to individuals.
• With other third parties with whom you direct us to share defined categories your personal information.

Discovery Fly Fishing may also disclose personal information about you if it believes such disclosure is necessary to comply with laws or respond to lawful requests and legal process or to protect or defend the rights, safety or property of Discovery Fly Fishing, users of the Services or any person including to enforce our agreements, policies and terms of use.

We do not sell your personal information to third parties for monetary compensation.

We do use advertising and analytics providers that set cookies and similar
identifiers across websites. Under some state privacy laws this counts as
“sharing” for cross-context behavioral advertising, whether or not any money
changes hands. You can opt out at any time — see “Your choices” below.

HOW WE PROTECT AND DISPOSE OF PERSONAL INFORMATION

We take seriously our responsibility to protect the security and privacy of your personal information. We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

Any suspected attempt to breach our policies and procedures, or to engage in any type of unauthorized action involving our information systems, is regarded as potential criminal activity. Suspected computer mischief may be reported to the appropriate authorities.

Please remember that communications over the internet such as emails are not secure. We seek to keep secure all confidential information and personal information submitted to us in accordance with our obligations under applicable laws and regulations.

However, like all website operators, we cannot guarantee the security of any data transmitted through the internet.

We retain the personal information we collect for different periods of time depending on what it is and how we use it. In some contexts, we will provide additional information about retention as you use the Services. When we collect your personal information, we will retain it only for as long as is necessary to complete the legitimate business or legal purposes for which we collected it. In many cases, the retention time period will correspond to the time period for which you have an account or other type of business relationship with us plus a defined period after that relationship ends which will be defined by our regulatory requirements.

COOKIES AND OTHER TRACKING TECHNOLOGIES

A “cookie” is a text file that is stored to your browser when you visit a website.

Unique device identifiers like IP address or UDID recognize a visitor’s computer or other device used to access the internet. Unique device identifiers are used alone and in conjunction with cookies and other tracking technologies for the purpose of “remembering” computers or other devices used to access the Site.

Cookies can be classified by duration and by source:

• Duration. The Sites use both “session” and “persistent” cookies. Session cookies are temporary – they terminate when you close your browser or otherwise end your “active” browsing session. Persistent cookies remember you on subsequent visits. Persistent cookies are not deleted when you close your browser, and they will remain on your computer or other device unless you choose to delete them (see below for “How to Delete or Block Cookies”).
• Source. Cookies can be “first-party” or “third-party” cookies, which means that they are either issued by or on behalf of Discovery Fly Fishing or by a third-party operator of another website. For an example of a third-party cookie, our Sites may contain a Facebook “like” button, which would set a cookie that can be read by Facebook. Our Sites may use both first-party and third-party cookies.

The cookies that we may use on the Sites fall into the following categories:

• Strictly Necessary Cookies. These cookies are necessary for the website to function and cannot be switched off in our systems. They are usually only set in response to actions taken by you such as logging in or filling in forms. You can set your browser to block or alert you about these cookies, but blocking them may impede the functionality of the Sites.
• Performance Cookies. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated. If you do not allow these cookies we will not know when you have visited our site, and will not be able to monitor its performance.
• Functionality Cookies. These cookies enable the Sites to provide enhanced functionality and personalization. They may be set by us or by third-party providers whose services we have added to our pages. If you do not allow these cookies then some of these services may not function properly.
• Targeting Cookies. Discovery Fly Fishing may set targeting cookies. These cookies may be set through our Sites by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites, including social media platforms. They are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising.

How to Delete or Block Cookies and Other Tracking Technologies

On some Sites, when technically feasible, we will enable tools to help you make choices about information collected through cookies and other tracking technologies. You may also delete or block cookies at any time by changing your browser settings. You can click “Help” in the toolbar of your browser for instruction or review the cookie management guide produced by the Interactive Advertising Bureau available at www.allaboutcookies.org. If you delete or block cookies, some features of the Sites may not function properly.

Discovery Fly Fishing may provide links on our Site to other websites that are not under our control. We do not endorse or make any warranty of any type regarding the content contained on such websites or products and services offered on those websites.

We encourage our users to be aware when they leave our Sites and to read the privacy statements of each and every website that collects personal information. This Notice applies solely to personal information collected by us. You should read any other applicable privacy and cookies notices carefully before accessing and using other websites.

The Sites and Services are not intended for use by children. We do not solicit or knowingly accept any personal information from persons under the age of 18 and we do not sell or share personal information of consumers under age 18. Please do not use the Site or Services if you are under the age of 18.

When a period ends we delete the information or remove anything that
identifies you from it. You can ask us to delete your information at any time,

  say what you would like. We will confirm your identity before we act, and we
  answer within the time the law allows.
• Opt out of advertising and analytics. Send a Global Privacy Control
  signal from your browser — we honor it — or use Google’s opt-out browser
  add-on, or block cookies in your browser settings.
• Stop receiving email from us. Use the unsubscribe link in any message.

You do not have to give us any of this information. If you do not, we may not
be able to provide the parts of the Services that depend on it.

Subject to certain exemptions, and in some cases dependent upon the processing activity we are undertaking, you have the right to:

If you provide personal information to us or access or use the Services after this Notice has been changed, you will be deemed to have unconditionally consented and agreed to such changes. Choice of Law. Except where prohibited by law, this Notice, including all revisions and amendments thereto, is governed by the laws of the United States, State of Oregon, without regard to its conflict or choice of law principles which would require application of the laws of another jurisdiction.
